Rallyist — Terms of Use
Last updated: 1 July 2026
Effective date: 1 July 2026.
These Terms of Use ("Terms") govern your access to and use of Rallyist (the "Services"), including the Rallyist mobile application, website at rallyist.app, the related APIs, and any feature offered through any of them. These Terms specifically incorporate Rallyist's Acceptable Use Policy, the Community Guidelines, and the Privacy Policy. In these Terms, the words "Rallyist," "us," "our," or "we" mean Rallyist, the entity providing the Services to you. The words "you" or "your" mean any individual or legal entity that accesses or uses the Services.
If you are in the European Union ("EU") or European Economic Area ("EEA"), the Services are provided to you by [Rallyist EU Entity, if formed; otherwise Rallyist acting under the EU representative listed in §24]. Otherwise, the Services are provided to you by Rallyist.
If you do not agree with these Terms, do not access or use the Services.
1. Eligibility and Account Registration
1.1 You must be at least 16 years old to create a Rallyist account in the EU/EEA, or at least 13 years old elsewhere, subject to applicable law in your jurisdiction. We do not knowingly collect data from children under these ages and will close any account we discover to be under-age.
1.2 To use most features, you must register an account using a supported authentication provider (Google or Apple). You may also be required to verify your email address before posting any user content.
1.3 You agree to keep your account information accurate and up to date, to keep your credentials secret, and to notify us immediately at support@rallyist.app of any unauthorised access. You are responsible for all activity on your account.
1.4 You may have only one Rallyist account at a time. Creating additional accounts to evade enforcement actions, accumulate karma artificially, or to impersonate another user is a violation of these Terms.
2. Description of the Services
2.1 Rallyist is a real-time platform for organising rallies, road trips, and meetups; for tracking convoys live; for chatting with other drivers; and for discovering cars, scenic routes, photo spots, points of interest, and events around you. The platform combines map-based content, peer-to-peer location sharing, voice channels, and a karma system that rewards constructive participation.
2.2 The information available through the Services — including location pings from other users, road conditions, hazard reports, photo spots, scenic routes, places of interest, opening hours, prices, event schedules, and any user-generated content — is intrinsically fluctuant and may be inaccurate, incomplete, outdated, delayed, or contributed by users we have not verified. You agree to use the Services with this in mind, to obey all applicable traffic laws, to keep your eyes on the road, and to interact with the Services only when it is safe to do so.
2.3 We may change, add, suspend, or remove features of the Services at any time, including changes to the karma system, the trust tiers, the moderation rules, or the privacy controls. Material changes will be notified to you in-app or via email at least 14 days before they take effect, except where a shorter notice period is required by law or by an urgent security or safety concern.
3. Safety and Driving
3.1 Do not interact with the Services while driving. You agree to use the in-motion safety features of the Services (the driving lock screen, voice-only mode, simplified map mode) when you are operating a vehicle. Reports, comments, votes, photos, and chat messages should be created only when your vehicle is stopped in an appropriate location, or by a passenger.
3.2 Live location sharing is opt-in and event-scoped. You can stop sharing your location at any time from the in-app controls. Other users in the same event can see your location and direction of travel while you share. We are not responsible for what other users do with this information once it is shared with them.
3.3 The hazard, alert, and rally call features rely on contributions from other users. We do not pre-screen these contributions and you agree that you will use them as one of multiple inputs to your driving decisions, never as the sole basis.
3.4 The Services are not a substitute for emergency services. If you are in an emergency, call your local emergency number first and then, if it is safe, use the Rallyist SOS feature to alert your group.
4. User Content and Conduct
4.1 "User Content" means anything you post, upload, transmit, share, or otherwise make available through the Services, including but not limited to: location traces, route GPX files, photos, photo spots, car spots, road whispers, road conditions, rally calls, help requests, event descriptions, club content, profile information, comments, chat messages, voice messages, recorded drive-room audio (where the recording feature is enabled and consented to), Drive Room recordings, and reports about other users or content.
4.2 You retain all rights you have in your User Content. By posting User Content to the Services, you grant Rallyist a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify (including by re-encoding, resizing, generating thumbnails or derivative perceptual hashes for moderation and de-duplication), distribute, publicly perform, and publicly display that User Content within the Services and in marketing materials about the Services, for as long as you keep that User Content on the Services. You also grant Rallyist a perpetual, irrevocable licence to keep aggregated, de-identified analytics derived from your User Content even after you delete it.
4.3 You represent and warrant that you own or have all necessary rights, licences, consents, and permissions to grant the licence in §4.2 for every piece of User Content you post, including for any identifiable person, vehicle, private property, or copyrighted material appearing in it.
4.4 The licence in §4.2 ends with respect to a piece of User Content when you delete it from the Services or when your account is closed, except for: (a) backup copies retained for a reasonable period for operational and legal-hold reasons (no longer than 90 days), (b) aggregated, de-identified analytics, (c) copies retained by other users who legitimately downloaded or shared the content while it was available, (d) information we are required to retain by law.
4.5 We do not pre-screen User Content. We reserve the right (but have no obligation) to review, remove, restrict, demote, geo-fence, or refuse to display any User Content for any reason consistent with these Terms, our Community Guidelines, our Acceptable Use Policy, or applicable law. Where we restrict or remove User Content, we will give you a statement of reasons and information about how to appeal under §14, except where doing so would frustrate the purpose of the action (e.g. an active law-enforcement investigation).
4.6 You may report User Content that you believe violates these Terms or applicable law using the in-app report tool. Reports are reviewed by our moderation team and we will tell you the outcome of any report you submit.
5. Karma, Validation, and Trust Tiers
5.1 The Services include a "karma" system that records, in an append-only ledger, certain actions you take that benefit other users (posting validated content, confirming sightings, hosting completed rallies, attending events, helping resolve roadside problems). Karma is a non-monetary, non-transferable signal of trust within the Services. Karma cannot be bought, sold, exchanged for money or property, or transferred between accounts, and we do not value it in any currency.
5.2 We may revoke, reduce, or expire karma at any time, with or without notice, including but not limited to: when content you posted is later removed by us; when you are found to have abused the validation loop (sock-puppeting, coordinated voting); when your account is suspended or terminated.
5.3 Some features, such as hosting rally calls, unlock as you earn karma or verify your email. We may ask for additional verification before unlocking a feature and may withdraw it if information you provided is inaccurate.
5.4 Impersonation is strictly prohibited. You may not, on or through the Services, impersonate or falsely represent affiliation with: any other person; any group, club, business, or marque; any public official, law enforcement officer, fire or emergency services worker, transport authority, or government agency; any Rallyist employee, contractor, moderator, or agent; or any media outlet, journalist, or influencer. Where verification of an organisation ("claimed organisation" tier) is desired, only the organisation itself may apply, through the documented org-claim process; individual employees may not claim the tier on the organisation's behalf without prior written authorisation from the organisation.
5.5 Violations of §5.4 will result in immediate, permanent termination of the account and may, where applicable, be referred to law enforcement. We will preserve evidence in accordance with law and respond to lawful requests from authorities for information about the account.
6. Live Location, Drive Rooms, and Voice
6.1 Live location sharing is event-scoped and opt-in. You acknowledge that other participants in the same event can see your real-time position, speed bucket, and direction while you share. You may stop sharing at any time. Historical location traces are stored and displayed according to your privacy settings; see the Privacy Policy for retention details.
6.2 Drive Rooms include a real-time voice channel powered by a third-party media server identified in our Privacy Policy. Voice is processed in real time and is not recorded by Rallyist by default. Where a host or participant enables voice recording, all participants in the room must be notified before recording begins and have an opportunity to leave. It is your responsibility, where recording features are used, to comply with the recording-consent laws of every jurisdiction whose residents are present in the room.
6.3 Chat messages, including text messages and voice notes, may be moderated automatically (for slurs, threats, NSFW content) and by human moderators on receipt of a report. Drive Room hosts may configure additional rules for their room consistent with these Terms.
7. Acceptable Use
You may not, and you may not encourage or assist any third party to:
(a) Use the Services in violation of any applicable law, regulation, or third-party right.
(b) Use the Services to engage in dangerous driving, including street-racing, drift events, top-speed runs, or any organised activity that violates the speed limit or other traffic laws of the jurisdiction in which it occurs. Rallies and events organised through the Services must comply with all applicable traffic laws.
(c) Post User Content that:
- sexually exploits or abuses children, or otherwise endangers minors;
- depicts non-consensual sexual content of any kind;
- contains gratuitous violence, gore, dead bodies, or content intended to shock;
- contains hate speech, slurs, or content directed at people on the basis of protected characteristics;
- threatens, harasses, intimidates, or stalks any person;
- dox individuals (publishes private personally-identifying information without consent);
- depicts an identifiable person without that person's consent in a context that would be embarrassing, defamatory, or harmful;
- depicts an identifiable vehicle in a context that suggests the operator was committing a traffic offence (e.g. tagging a licence plate as "this guy is a bad driver");
- infringes any copyright, trademark, trade secret, moral right, or other intellectual-property right;
- is materially false, fabricated, or misleading and likely to cause harm (e.g. fake hazard reports, fake rally calls, fake spots designed to humiliate or mislead);
- falsely identifies a person, group, organisation, or law-enforcement presence (see §5.4);
- constitutes spam, undisclosed paid promotion, multi-level marketing, or solicitation of the Rallyist user base for commercial purposes outside the channels we provide.
(d) Use the Services to track, surveil, or follow another person without their consent.
(e) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except where this restriction is prohibited by applicable law.
(f) Scrape, crawl, or otherwise systematically extract content from the Services except via the public API where one is offered and in compliance with that API's terms.
(g) Interfere with the operation of the Services, including by running automated scripts, bots, brute-force attempts, denial-of- service attacks, or any other action that imposes an unreasonable load on our infrastructure.
(h) Misuse the safety features of the Services. In particular, you may not file false safety, SOS, or hazard reports; you may not abuse the report-other-users feature to retaliate against users you disagree with.
(i) Circumvent, attempt to circumvent, or assist others in circumventing any technical or policy enforcement of the Services, including by using a VPN to access content geo-fenced for legal reasons or by creating new accounts after enforcement action.
8. Moderation, Enforcement, and Appeals
8.1 We use a combination of automated systems (image moderation, text moderation, behavioural anomaly detection) and human reviewers to enforce these Terms. We will exercise our enforcement discretion in good faith and proportionately.
8.2 Where we take action against your User Content or your account (removal, demotion, geo-restriction, posting block, account suspension, termination), we will provide you with a statement of reasons identifying the rule violated and the action taken, and information about how to appeal, except where the law or an active investigation prohibits us from doing so. This commitment matches the notice-and-action obligations imposed on online platforms by the EU Digital Services Act (Articles 16–17).
8.3 You may appeal an enforcement action by contacting us through the in-app appeal flow within 30 days of the action. We will review appeals in a non-discriminatory, diligent, and timely manner, and inform you of the outcome.
8.4 If you are an EU resident and are not satisfied with the outcome of your internal appeal, you have the right to seek out-of-court dispute settlement under Article 21 of the EU Digital Services Act through any certified body listed by your national Digital Services Coordinator. Where Rallyist becomes subject to that obligation by ceasing to qualify as a micro or small enterprise, the names of the certified bodies we cooperate with will be listed in §24.
8.5 Repeat or severe violations may result in termination without prior warning.
9. Intellectual Property
9.1 Other than the licence you grant us under §4.2, all intellectual property in the Services — including the Rallyist name, logo, brand elements, software, design system, map tile cache, recommended routes, curated content, karma algorithm, and any aggregated insights — is owned by Rallyist or our licensors. Nothing in these Terms transfers any of those rights to you.
9.2 If you believe any material on the Services infringes your copyright, please send a notice that complies with the U.S. Digital Millennium Copyright Act (DMCA) or, if you are in the EU, with the notice-and-action procedure of the EU Digital Services Act, to copyright@rallyist.app. Repeat infringers will have their accounts terminated.
10. Premium Features and Paid Plans
10.1 If we offer premium subscriptions, in-app purchases, or paid events through the Services, additional terms will be presented to you at the point of purchase and will form part of these Terms with respect to that purchase.
10.2 Subscriptions and in-app purchases bought through Apple or Google are subject to those platforms' refund policies. Where law gives you a right of withdrawal (for example, the 14-day right under EU consumer law), we will honour it.
11. Third-Party Services and Integrations
The Services interoperate with third-party services (for example maps, weather data, voice, and Apple or Google sign-in). Your use of those services is subject to their own terms; we are not responsible for their content or operation, except for Rallyist's role as the controller of personal data they process on our behalf, as described in the Privacy Policy.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RALLYIST DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR TRADE USAGE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES; THAT USER CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR THAT ANY ROUTE, ROAD CONDITION, HAZARD REPORT, EVENT, RALLY CALL, OR OTHER INFORMATION ON THE SERVICES IS SAFE TO RELY ON FOR YOUR DRIVING DECISIONS.
If your jurisdiction does not allow the disclaimer of certain implied warranties, the warranties disclaimed in this section are disclaimed to the maximum extent permitted by that law and the rest of this section continues in force.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RALLYIST AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID RALLYIST IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR (B) US$100.
NOTHING IN THIS SECTION LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.
14. Indemnity
You will defend, indemnify, and hold harmless Rallyist and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your User Content; your use of the Services in violation of these Terms; your violation of any applicable law; or your violation of any third-party right. We will give you prompt notice of any claim we want you to defend, allow you to control the defence of the claim with counsel of your choosing reasonably acceptable to us, and cooperate with you in the defence at your reasonable expense.
15. Termination
15.1 You may close your Rallyist account at any time from the in-app Settings → Account → Delete Account flow. On account closure, we will, within 30 days, delete or anonymise your personal data according to the schedule in the Privacy Policy, except for information we are legally required to retain.
15.2 We may suspend or terminate your account at any time, with or without prior notice, for: (a) breach of these Terms or any incorporated policy; (b) requests by law enforcement or government authorities; (c) extended inactivity (no sign-in for 24 months will trigger a notice and a 90-day grace period before account closure); (d) discontinuance of the Services or any material part of them; (e) unexpected technical, security, or safety issues that make continued provision of your account impractical.
15.3 Sections that by their nature should survive termination (including Content and Conduct, Karma, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnity, Governing Law, and General) will survive termination.
16. Changes to These Terms
We may update these Terms from time to time. The "Effective date" at the top of these Terms shows when the current version took effect. For material changes, we will notify you in-app or by email at least 14 days before the new Terms take effect, except where a shorter notice is required by law or by an urgent security or safety concern. If you continue to use the Services after the new Terms take effect, you accept them. If you do not accept them, your remedy is to close your account.
17. Governing Law and Dispute Resolution
17.1 These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws principles. This does not take away any mandatory consumer-protection rights you have under the law of the country where you live, and you may bring a claim in the courts of your own country where that law allows it.
17.2 Before going to court, write to legal@rallyist.app and we will try to resolve the problem with you directly.
17.3 If any provision of these Terms is found unenforceable, the remainder will continue in full force and effect.
18. General
18.1 These Terms (together with the documents they incorporate) constitute the entire agreement between you and Rallyist regarding your use of the Services.
18.2 No failure or delay by us to enforce any right under these Terms will be a waiver of that right.
18.3 You may not assign or transfer these Terms or any right or obligation under them. We may assign or transfer these Terms in connection with a merger, acquisition, reorganisation, or sale of substantially all of our assets.
18.4 Notices to you may be sent by email, in-app message, or by posting to the Services. Notices to us must be sent to legal@rallyist.app.
19. Contact
